These govern this website and the booking system. The trailer itself is governed by the separate rental agreement you sign.
Two documents, two jobs
This one covers using the website — accounts, bookings, what's on the pages. The Rental Agreement covers possessing and towing a trailer, and that's where the liability, insurance and damage terms live. Nothing on this page replaces or limits that agreement.
By using this website you agree to these terms. When you book, you'll be asked to tick a box confirming you've read them, the Rental Agreement, and the Privacy Policy. That box is never pre-ticked, and you can read all three in full before you tick it.
If you don't agree, please don't use the site — call us instead and we'll take your booking over the phone.
You must be at least 18 to create an account and at least 25 to rent a trailer. You're responsible for keeping your password to yourself and for anything done through your account. Tell us right away if you think someone else has got into it.
Give us accurate information. Booking under a false name, with someone else's card, or with a license that isn't yours ends the booking and may be a criminal matter.
3.1 Submitting dates is a request, not a confirmed booking. A trailer is yours when we confirm it — we aim to do that the same day. Nothing is charged before we confirm.
3.2 We try hard to keep rates and availability accurate and the calendar is generated from live booking data. If an obvious error appears — a rate that's clearly wrong, or a trailer shown free that isn't — we may decline the request and will tell you why and refund anything taken. We won't use this to escape a price you booked in good faith.
3.3 Rates shown exclude the Texas motor vehicle rental tax, which is itemized before you confirm. Every fee is shown before you commit — there are no charges that first appear at pickup.
3.4 The security deposit is an authorization hold, not a charge. See the Rental Agreement for how and when it's released.
3.5 Cancellation terms are in the Rental Agreement, section 10.
4.1 Trailer specifications, dimensions and weight ratings are taken from the manufacturer and from our own units. We work to keep them accurate. Verify any figure your safety depends on against the actual trailer and its data plate before you tow it — the plate on the trailer is the authority, not this website.
4.2 The towing guide is general information, not legal advice. We researched it carefully and cite the law where we can, but rules change and how they apply depends on your equipment and your use. Check with the Texas Department of Public Safety or TxDMV if you're near a limit.
4.3 Nothing on this site is an insurance product or insurance advice. We do not sell insurance and we do not offer a damage waiver. Renters are responsible for damage to the trailer — see the Rental Agreement, sections 6 and 7.

Photographs, messages and information you send us stay yours. You give us permission to use them to run your rental and resolve any dispute about it. We will not use your photos or words in advertising without asking you first.
The Spangler's Trailer Rentals name, logo, page designs, photographs and written content are ours. You're welcome to link to us. Please don't copy the site wholesale or use our logo as if you were us.
We'd like the site to be up all the time and it usually will be, but we don't promise uninterrupted access. We may take it down for maintenance. If the site is down when you need to book, call us.
The site links to a few third-party services — our payment processor, mapping. We're not responsible for their content or their policies.
THIS WEBSITE IS PROVIDED "AS IS" AND "AS AVAILABLE". SPANGLER'S DISCLAIMS ALL IMPLIED WARRANTIES RELATING TO THE WEBSITE, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
EXCEPT FOR CLAIMS OF BODILY INJURY BROUGHT BY A CONSUMER, SPANGLER'S TOTAL LIABILITY ARISING FROM YOUR USE OF THIS WEBSITE IS LIMITED TO THE AMOUNT YOU PAID US FOR THE BOOKING THE CLAIM RELATES TO, OR $100 IF THERE IS NO SUCH BOOKING.
SPANGLER'S IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE. THIS DOES NOT APPLY TO GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR INTENTIONAL ACTS, AND DOES NOT LIMIT ANY LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
THE RISK-SHIFTING TERMS THAT APPLY TO THE TRAILER ITSELF ARE IN THE RENTAL AGREEMENT, NOT HERE. THIS SECTION COVERS THE WEBSITE ONLY.

Your booking is governed by the version of these terms and of the Rental Agreement that was in force when you booked. We keep every version.
Texas law governs these terms, without regard to conflict-of-laws rules. Spangler's Trailer Rentals is located in Guadalupe County, Texas.
The mutual jury waiver in the Rental Agreement applies to disputes about a rental. Either of us may bring an individual claim in a Texas justice court.
Before anyone sues, please talk to us. Email or call, tell us what's wrong, and give us 30 days to fix it. Most of what could go wrong here is fixable in a phone call, and we'd much rather have that call.
11.1 Severability. If any provision is held unenforceable in whole or part, it's reformed to the maximum enforceable extent and the rest stands.
11.2 No waiver. Not enforcing something once doesn't give it up.
11.3 Order of precedence. If these terms conflict with the signed Rental Agreement about a rental, the Rental Agreement wins.
